MINUTES



Representative Debra Hilstrom, Chair of the Local Government and Metro Affairs Committee, started the 25TH meeting at 12:31 pm on Wednesday, February 27, 2008 in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF2896 (Thissen): War veterans memorial referendum requirement removed.

Rep. Thissen presented HF2896 and took questions from the committee.

Chair Hilstrom laid HF2896 over.

HF2753 (Rukavina): White Community Hospital District established and authorized to levy property taxes.

Rep. Rukavina presented HF2896 and took questions from the committee.

The following individuals testified on behalf of HF2753 and took questions from the committee:

Mary Hess, Mayor of the city of Aurora

A quorum was present at 12:43pm, and the meeting was officially called to order.

Chair Hilstrom moved to orally amend HF2753 as follows:

Page 1, line 10, delete everything after the period

Page 1, delete lines 11 to 13

Page 1, after line 13, insert, "The proposed resolution to establish the hospital district must be published and is subject to referendum as provided in section 447.31, subdivision 2."

Page 2, line 9, delete "…" and insert "51"
THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Chair Hilstrom moved that HF2753, as amended, be recommended to pass and be re-referred to the Committee on Taxes.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF2932 (Moe): Cemetery fund use specified.

Chair Hilstrom moved HF2932 be recommended to pass and be placed on the General Register.

Chair Hilstrom moved to amend HF2932 (see A08-1170).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Moe presented HF2932 as amended and took questions from the committee.

Kent Sulem, Minnesota Association of Townships, testified on behalf of HF2932 as amended and took questions from the committee.

Chair Hilstrom moved that HF2932, as amended, be recommended to pass and be placed on the General Register.

Chair Hilstrom brought back HF2896 for further discussion.

Rep. Buesgens moved to orally amend HF2896 as follows:

Chair Hilstrom moved that HF2896, as amended, be recommended to pass and be placed on the Consent Calendar.

HF3225 (Fritz): Medford; local sales tax and use authorized.

Chair Hilstrom moved that HF3225 be re-referred to the Committee on Taxes without further recommendation.

Rep. Fritz presented HF3225 and took questions from the committee.

Chair Hilstrom renewed her motion that HF3225 be re-referred to the Committee on Taxes without further recommendation.

HF2780 (Jaros): Duluth; food and beverage sales tax rate increase authorized; proceeds authorized for certain improvements.

Chair Hilstrom moved that HF2780 be re-referred to the Committee on Taxes without further recommendation.

Rep. Jaros presented HF2780 and took questions from the committee.

Chair Hilstrom renewed her motion that HF2780 be re-referred to the Committee on Taxes without further recommendation.

HF2827 (Welti): County historical society funding modified relating to cities of the first class.

Chair Hilstrom moved that HF2827 be recommended to pass and be placed on the General Register.

Rep. Welti presented HF2827 and took questions from the committee.

Iru Plitzuweit, President of the Olmsted County Historical Society, testified on behalf of HF2827 and took questions from the committee.

Chair Hilstrom renewed her motion that HF2827 be recommended to pass and be placed on the General Register.

HF2907 (Peterson, A.): Yellow Medicine County; appointive offices process provided.

Chair Hilstrom moved that HF2907 be recommended to pass and be placed on the General Register.

Rep. Peterson presented HF2907 and took questions from the committee.

Ryan Krosch, Yellow Medicine County Administrator testified on behalf of HF2907 and took questions from the committee.

Chair Hilstrom renewed her motion that HF2907 be recommended to pass and be placed on the General Register.

HF2816 (Morrow): Nicollet County auditor-treasurer office made appointive.

Chair Hilstrom moved that HF2816 be recommended to pass and be placed on the General Register.

Rep. Morrow presented HF2816 and took questions from the committee.

Robert Poohradsky, of Nicollet County, testified on behalf of HF2816 and took questions from the committee.
Chair Hilstrom renewed her motion that HF2816 be recommended to pass and be placed on the General Register.

HF2906, 1st Engrossment (Paymar): Dangerous Dogs regulating provisions changed.

Chair Hilstrom moved that HF2906, 1st Engrossment be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

Rep. Paymar presented HF2906, 1st Engrossment, and took questions from the committee.

Chair Hilstrom moved to amend HF2906, 1st Engrossment (see H2906A9).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Bill Forbes, Minnesota Animal Control Association, testified on behalf of HF2906, 1st Engrossment as amended and took questions from the committee.

Chair Hilstrom renewed her motion that HF2906, 1st Engrossment, as amended, be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Public Safety Finance.

SF357, 1st Engrossment (Clark): Low-income and moderate-income housing developers transactions with local units of government regulated.

Chair Hilstrom took up SF357, 1st Engrossment in lieu of HF2249 and moved that it be recommended to pass and re-referred to the Committee on Housing Policy Finance & Public Health.

Rep. Clark presented SF357, 1st Engrossment, and took questions from the committee.

Vice-Chair Tschumper assumed the gavel at 1:53pm.

Vice-Chair Tschumper moved to amend SF357, 1st Engrossment (see S0357A2).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Matthew Soucek, Project for Pride in Living, testified on behalf of SF357, 1st Engrossment, as amended and took questions from the committee.

Vice-Chair Tschumper renewed Chair Hilstrom's motion that SF357, 1st Engrossment, as amended, be recommended to pass and re-referred to the Committee on Housing Policy Finance & Public Health.
