MINUTES


Chair Wagenius called the meeting to order at 8:31 A.M. on March 31, 2009 in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

John Jaschke, Executive Director, and Julie Klocker, Assistant Director, Board of Soil and Water Resources (BWSR), presented the 2010-2011 budget.

A quorum was present at 8:38 A.M.


HF1493 Lillie, State parks and trails funding provided, money appropriated, planning and report required.

Representative Lillie moved and presented his bill. Judy Erickson of the Parks and Trails Council testified in favor.

HF1493 was laid over for possible inclusion in the parks and trails funding recommendations.


HF2055 Slawik, Ramsey County; Land acquisition funding provided, and money appropriated.

Chair Wagenius moved the bill.

Ken Hartwig of Prairie Visions Citizens’ Group testified in favor.

HF2066 Mack, Minnesota Zoo water quality funding provided, and money appropriated.

Chair Wagenius moved the bill.

Lee Ehmke, Executive Director, Minnesota Zoo, testified in support.

HF2066 was laid over for possible inclusion in the clean water funding recommendations.


HF2004 Hortman, Coon Rapids; Bicycle and pedestrian trail grant funding provided, money appropriated.

Representative Hortman moved and presented her bill.

HF2004 was laid over for possible inclusion in the parks and trails funding recommendations.


Representative Persell moved the minutes of March 26, with the change that Representative Torkelson be marked as excused. The motion prevailed.

The committee recessed at 9:55 A.M.

The committee reconvened at 4:35 P.M.


HF671 Dettmer, Residency requirements eliminated for veterans obtaining complimentary state park passes.

Chair Wagenius moved the bill.

Representative Dettmer presented his bill.

HF671 was laid over for possible inclusion in an omnibus finance bill.


HF1674 Hausman, Disposition of receipts to the parks and trails fund provided, grant program established, money appropriated.

Representative Scalze moved the bill and the H1674A1 amendment. The motion prevailed and the amendment is adopted.

Representative Hausman presented her bill as amended.

HF1674 was laid over for possible inclusion in the parks and trails funding recommendations.


HF1967 Haws, Park and trails legacy grant program established, and appointments provided.

Chair Wagenius moved HF1967 be recommended to pass and go to Finance, with a recommendation for re-referral to Cultural and Outdoor Resources Finance.

Chair Wagenius moved an oral amendment as follows: line 1.11, in the blank for the appropriation, insert "$250,000". The motion prevailed and the amendment was adopted.

Representative Haws testified on his bill as amended.

Marc Mattice of Wright County Parks and Laird Mork of Chisago County Parks testified in support.

Representative Wagenius moved an oral amendment as follows: delete lines 1.6 through 1.9. The motion prevailed and the amendment was adopted.

HF2235 Clark, Drinking water source protection funding provided, and money appropriated.

Representative Clark moved her bill.

Representative Clark moved the H2235A1 amendment. The motion prevailed and the amendment was adopted.

Linda Bremmer, Acting Director of Environmental Health, Minnesota Department of Health, testified in support.

Representative Clark renewed her motion and HF2235 as amended was laid over for possible inclusion in the clean water recommendations.


HF1991 Scalze, Coal tar prohibited, notification and planning required, and money appropriated.

Representative Scalze moved her bill and the H1991DE3 amendment. The motion prevailed and the amendment was adopted.

Craig Johnson of the League of Minnesota Cities testified in support.

Lisa Thorvig, Division Director, Minnesota Pollution Control Agency, testified in response to questions.

Representative Scalze renewed her motion and HF1991 was laid over for possible inclusion in the clean water recommendations.


HF2197 McNamara, Lake St. Croix comprehensive water monitoring and phosphorus reduction funding provided, and money appropriated.

Representative McNamara moved and presented his bill.

Gaylen Reetz, Divison Director, Minnesota Pollution Control Agency, testified.

Representative McNamara renewed his motion and HF2197 was laid over for possible inclusion in the clean water funding recommendations.


HF403 Gardner, Plastic yard waste bags required to be compostable, and biodegradable and compostable standards for certain plastics established.

Chair Wagenius moved the bill and the H0403A6 amendment.

Representative Gardner moved an amendment to the amendment as follows: line 1.6 change "2012" to "2013". The amendment was incorporated and the amendment was adopted.

Representative Gardner presented his bill as amended.

HF403 was laid over for possible inclusion in the omnibus finance bill.


HF1727 Hansen, Wellhead protection areas made eligible for the reinvest in Minnesota reserve program, conservation reserve program modified, and money appropriated.

Representative Hansen presented his bill.

HF1727 was laid over for possible inclusion in the clean water fund recommendations.


(Informational Hearing) HF1070 Eken, Red River Valley river watch program funding provided, money appropriated.

Ron Harnack of the Red River Watershed Management Board testified in support.


HF2128 Eken, Clean water fund legacy activities funding provided, and money appropriated.

Chris Elvrum, Manager of Water Supply Planning with the Metropolitan Council, testified.

HF2092 Eken, Red River basin management and water quality improvement funding provided, and money appropriated.

Steve Chaplin of the Nature Conservancy testified in support.

Chair Wagenius changed her motion and laid the bill over for possible inclusion in the omnibus finance bill.


HF1552 Persell, Star Lake Board grant funding provided, and money appropriated.

Representative Persell moved and presented his bill.

HF1552 was laid over for possible inclusion in the clean water recommendations.


HF487 Hackbarth, All-terrain vehicle registration exemptions modified and nonresident all-terrain vehicle operators required to possess a state trail pass.

Representative Hackbarth moved and presented his bill.

Ron Potter of the Department of Natural Resources Parks and Trails Division testified in support.

HF487 was laid over for possible inclusion in the omnibus finance bill.


HF877 Hortman, Idling reduction technology purchases grant program established.

Representative Hortman moved and presented her bill.

Amber Backhaus of the Minnesota Trucking Association testified in support.

Representative Hortman moved an oral amendment as follows: line 2.21, strike "state" and insert "National, Smartway, or Emerging Technologies". The motion prevailed and the amendment was adopted.

Representative Hortman renewed her motion. The motion prevailed and HF877 as amended is recommended to pass and re-referred to Finance.


HF2123 Wagenius, Waters required to be monitored for endocrine disruptors and other compounds, and money appropriated.

Chair Wagenius moved her bill and the H2123DE1 amendment. The motion prevailed and the amendment was adopted.

Representative Wagenius presented her bill and renewed her motion.

HF2123 was laid over for possible inclusion in the clean water funding recommendations.


HF1973 Wagenius, Lower Minnesota River biological assessment funding provided, and money appropriated.

Representative Wagenius moved and presented her bill.

HF1973 was laid over for possible inclusion in the clean water funding recommendations.


HF2049 Wagenius, Environment and natural resources funding provided, and money appropriated.

Representative Wagenius moved that HF2049 be recommended to pass and re-referred to Finance.

Representative Wagenius moved the H2049A1 amendment. The motion prevailed and the amendment was adopted.

Representative Wagenius moved the H2049A3 amendment. The motion prevailed and the amendment was adopted.

Representative Wagenius and Susan Thornton, Director of the Legislative-Citizen Commission on Minnesota Resources presented the bill as amended.

Representative Wagenius renewed her motion. The motion prevailed and HF2049 is recommended to pass and re-referred to Finance.
