MINUTES


Chair Hansen called the meeting to order at 8:34 A.M. on April 14, 2009 in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present at 8:37 A.M.


HF2123 Wagenius, Omnibus environment and natural resources bill.

Representative Wagenius moved that her bill be recommended to pass and returned to the committee on Finance and moved the H2123DE1-3 amendment. The motion prevailed and the amendment was adopted.

Representative Wagenius presented her bill as amended.

Representative Persell took the gavel at 8:57 A.M.

Representative Hansen presented the Board of Soil and Water Resources (BWSR) portion of the bill.

Representative Scalze moved the minutes of April 7. The motion prevailed and the minutes are approved.


The committee recessed at 9:55 A.M.

The committee reconvened at 6:38 P.M. in room 200.


Representative Wagenius renewed her motion that HF2123 as amended be recommended to pass and returned to Finance.

Representative Dill moved the H2123A2 amendment and incorporated the following oral amendment: line 2.8, after "facility", insert "in the seven-county metropolitan area". The motion prevailed and the amendment was adopted.

Representative Knuth moved the H2123A5 amendment. The motion prevailed and the amendment was adopted.

Representative Wagenius moved the H2123A6 amendment. The motion prevailed and the amendment was adopted.

Representative Anzelc moved the H2123A4 amendment. The motion prevailed and the amendment was adopted.

Representative McNamara moved the H2123A7 amendment and asked for a roll call.

Ayes: Hackbarth, Anderson, Hamilton, McNamara, Torkelson
Nays: Wagenius, Persell, Anzelc, Clark, Dill, Doty, Hansen, Hortman, Knuth, Lillie, Scalze

With 5 ayes and 11 nays, the motion failed.

Representative Persell moved the H2123A8 amendment. Representative McNamara asked for a roll call.

Ayes: Hackbarth, Anderson, Doty, Hamilton, McNamara, Torkelson
Nays: Wagenius, Persell, Anzelc, Clark, Dill, Hansen, Hortman, Knuth, Lillie, Scalze

With 6 ayes and 10 nays, the motion failed.

Representative McNamara moved the H2123A9 amendment and asked for a roll call.

Nays: Wagenius, Persell, Clark, Doty, Hansen, Hortman, Knuth, Lillie, Scalze

With 7 ayes and 9 nays, the motion failed.

Representative Hamilton moved the H2123A10 amendment and asked for a roll call.

Nays: Wagenius, Persell, Anzelc, Clark, Dill, Doty, Hansen, Hortman, Knuth, Lillie, Scalze

With 5 ayes and 11 nays, the motion failed.

Representative Persell moved the H2123A11 amendment. Representative Torkelson asked for a roll call.

Ayes: Hackbarth, Anderson, Hamilton, McNamara, Torkelson

Nays: Wagenius, Persell, Anzelc, Clark, Doty, Hansen, Hortman, Knuth, Lillie, Scalze

With 5 ayes and 10 nays, the motion failed.

Representative Knuth moved the H2123A13 amendment.

David Thornton of the Minnesota Pollution Control Agency (MPCA) testified in response to a question.

Representative Knuth incorporated the following oral amendment as follows: line 1.7, strike "deems" and insert "determines by rule" The motion prevailed and the amendment was adopted.

Representative Torkelson moved the H2123A14 amendment.

Discussion ensued. Representative Torkelson withdrew his amendment.

Representative Hackbarth moved the H2123A15 amendment and asked for a roll call.

Bob Meier of the Department of Natural Resources (DNR) testified in response to a question.

Doug Franzen of the Snowmobilers’ Association testified in support of the amendment.

Representative Hackbarth renewed his motion.

Ayes: Persell, Hackbarth, Anderson, Anzelc, Dill, Doty, Gunther, Hamilton, Hansen, Hortman, McNamara, Scalze, Torkelson

Nays: Wagenius, Clark, Knuth, Lillie

With 13 ayes and 4 nays, the amendment was adopted.

Representative Hortman moved the H2123A17 amendment. The motion prevailed and the amendment was adopted.

Representative Hansen moved the H2123A19 amendment. The motion prevailed and the amendment was adopted.

Representative Hackbarth moved the H2123A20 amendment.

Ayes: Anderson, Hamilton, McNamara, Torkelson

Nays: Wagenius, Persell, Anzelc, Clark, Dill, Doty, Hansen, Hortman, Knuth, Lillie, Scalze

With 4 ayes and 11 nays, the motion failed.

Representative Hansen moved the H2123 A23 amendment. The motion prevailed and the amendment was adopted.

Representative Torkelson moved the H2123A24 amendment and asked for a roll call.

Discussion ensued. Representative Torkelson withdrew his amendment.

Representative Hortman moved the H2123A22 amendment.

Carl Michaud, Director of Hennepin County Environmental Services testified in opposition.

Barry Tilley with Dakota County testified in opposition.

Representative Hortman withdrew her amendment.

Representative Hamilton moved the A09-0427 amendment. The motion failed.

Representative McNamara moved the A09-0424 amendment and asked for a roll call.

Ayes: Hackbarth, Hamilton, McNamara, Torkelson

Nays: Wagenius, Persell, Anzelc, Clark, Dill, Doty, Hansen, Hortman, Knuth, Lillie, Scalze

With 4 ayes and 11 nays, the motion failed.

Representative Hackbarth withdrew the A09-0426 and A09-0437 amendments.

Representative Hackbarth moved an oral amendment to change the amount of some appropriations on lines 18.30 and 22.15.

Jim Conrad, Director of Enforcement, DNR, testified.

Representative Hackbarth withdrew his amendment.
