Representative Hornstein, Chair of the Transportation and Transit Policy and Oversight Division called the meeting to order at 4:35 P.M. on Tuesday, March 9, 2010 in Room 10 of the State Office Building. The Committee Legislative Assistant noted the roll.

HF3263 (Hortman) Speed limits in highway work zones governing provisions modified. Cassandra Isackson, MnDOT, spoke to the bill. Rep. Hortman moved adoption of the H3263A1 amendment. THE MOTION PREVAILED. Rep. Hortman moved that HF 3263, be recommended to pass, as amended, and placed on the General Register. THE MOTION PREVAILED.

HF3173 (Beard) Railroad property exempted from storm sewer or storm water utility assessments, levies, or charges. Mark Wegner, President, Twin Cities & Western Railroad and Brian Sweeney, BNSF Railway Council, spoke to the bill. Rep. Hornstein moved adoption of the H3173A1 amendment. THE MOTION PREVAILED. Craig Johnson, League of Minnesota Cities spoke in opposition to the bill. Rep. Hornstein moved that HF 3173, as amended, be passed to the State and Local Government Operations, Reform, Technology and Elections Committee. THE MOTION PREVAILED.

HF2851 (Nornes) Trunk highway system route removed. Erik Rudeen, Mn/DOT Government Affairs,spoke to the bill. Rep. Hornstein moved adoption of the H2851A1 amendment. THE MOTION PREVAILED. Rep. Hornstein moved that HF 2851, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF3008 (Anzelc) Type III vehicle drivers requirements amended. Tom Keliher, MN School Bus Operators Association, spoke to the bill. Rep. Hornstein moved adoption of the A10-2278. THE MOTION PREVAILED. Lt. Edward Carroll, State Patrol, spoke to the amendment and bill. Rep. Hornstein moved that HF 3008, as amended, be recommended to pass and referred to the Local Government Operations, Reform, Technology and Elections Committee. THE MOTION PREVAILED.

HF3117 (Morrow) Motor carrier contracts regulated and indemnification provisions prohibited. Keith Klein, Chairman, and John Hausladen, President, Minnesota Trucking Association, spoke to the bill. Rep. Morrow moved adoption of the SCS2469A-3 amendment. Matt Burress offered the following verbal amendment to the SCS2469A-3 amendment:

Page 1, line 27, delete "either"
Page 1, delete line 28
Page 1, line 29, delete "(1)"
Page 1, line 30, delete the semi colon and insert a period

The amended SCS2469A-3 amendment, as verbally amended, was before the committee. THE MOTION PREVAILED. Rep. Morrow moved adoption of the H3117A4 amendment. THE MOTION PREVAILED. Rep. Morrow moved that HF 3117, as amended, be recommended to pass and referred to the Commerce Committee. THE MOTION PREVAILED.

HF2915 (Lieder) Bridge project ongoing prioritization provided. Nancy Daubenberger, Mn/DOT Bridge Office, spoke to the bill. Rep. Lieder moved that HF 2915 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF3334 (Juhnke) Trunk highway project bidding procedures amended, and use of alternative bidding required for competing paving materials. Curt Turgeon, Mn/DOT Materials Office, and Harris Dunnick, Spicer, spoke to the bill. Rep. Hornstein moved that HF 3334 be recommended to pass and referred to the Finance Committee with recommendation that it be rereferred to the Transportation Finance Committee. THE MOTION PREVAILED.

Rep. Urdahl moved adoption of the minutes from March 4, 2010. THE MOTION PREVAILED.


HF3168 (Nelson) Escort drivers of overdimensional loads allowed to control traffic, and commissioner of public safety directed to establish escort driver training and certification program. The following spoke to the bill:

Rep. Hornstein moved that HF 3168 be recommended to pass and referred to the Local Government Operations, Reform, Technology and Elections Committee. THE MOTION PREVAILED.

HF3075 (Severson) Relinquished land owned by the Department of Transportation governing requirements established. Jim Povich, Mn/DOT District 3 Engineer and Frank Klein, St Cloud, spoke to the bill. Rep. Severson asked that the bill be laid over.

HF3099 (Champion) Commissioner of transportation directed to require bids for federally assisted contracts to include information on the inclusion of disadvantaged business enterprises, commissioner required to provide training for disadvantaged business enterprises, and reporting requirements imposed. Rep. Morrow moved the following oral amendment:

Page 3, line 1, delete "in various"
Page 3, line 2, delete "metropolitan area locations" and insert: "throughout the state"

THE MOTION PREVAILED. Rep. Champion moved the following oral amendment:

Page 2, delete Subd. 2.
Renumber the subdivisions in sequence
