Public safety officials would find their ability to seize weapons during declared state of emergencies limited under new restrictions passed 88-42 Thursday by the House.
HF722 would clarify how and why police officers can take possession of legal firearms from private individuals during declared emergencies related to public disorders or disasters.
Rep. Jim Newberger (R-Becker), the bill’s sponsor, said it would “make sure Minnesotans have the ability to defend themselves, and their family and their property during declared states of emergency.”
Under the bill, officers could only disarm individuals temporarily and if they believe there’s an immediate need. No government agent or unit could prohibit lawful possession, transfer or use of a firearm; could not seize or commandeer a firearm; revoke or suspend a permit; nor limit the ability of firearm-related businesses to operate under a state of emergency.
The bill now goes to the Senate, where Sen. Dave Thompson (R-Lakeville) is the sponsor.
