CIVIL JUSTICE POLICY COMMITTEE

MINUTES


Representative Mullery, Chair of the Civil Justice Policy Committee, called the meeting to order at 10:05 a.m., on Friday, March 19, 2010, in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Kulick-Jackson moved that the minutes of March 17, 2010, be adopted. THE MOTION PREVAILED.

H.F. 3106 (Bigham): A bill for an act relating to public safety; modifying implied consent, driving while impaired, and ignition interlock provisions; amending Minnesota Statutes 2008, sections
169A.52, subdivisions 3, 4; 169A.54, subdivisions 2, 5; 169A.55, by adding a subdivision; 169A.60, subdivision 1; 171.09; 171.30, subdivisions 1, 2a, 4; 171.306, as amended; 609.131, subdivision 2; Minnesota Statutes 2009 Supplement, sections 169A.275, subdivision 7; 169A.54, subdivision 1; repealing Minnesota Statutes 2008, sections 169A.54, subdivision 11; 169A.55, subdivision 1; 171.30, subdivision 2c; 171.305, subdivisions 1, 3, 4, 5, 6, 7,8, 9, 10, 11.

Representative Hilstrom moved HF 3106 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Transportation Finance.

Representative Hilstrom moved adoption of H3106A20 amendment. THE MOTION PREVAILED. Representative Hilstrom and Representative Bigham explained the amendment. Representative Mahoney voted no on the amendment.

Representative Drazkowski; Commissioner Michael Campion, Department of Public Safety; Mark Ritchie, Secretary of State; Cheri Marti, Department of Public Safety; Jean Ryan, Department of Public Safety; and Pat McCormack, Department of Public Safety, Driver & Vehicle Services.

Chair Mullery announced HF 1157 (Dill) is being removed from the agenda.

Representative Drazkowski moved adoption of the H3106A21 amendment. Rep. Drazkowski, Rep. Bigham, Cheri Marti, Jean Ryan and Pat McCormack explained the amendment. THE MOTION PREVAILED.

Representative Hilstrom renews the motion that HF 3106, as amended, be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Committee on Transportation Finance. THE MOTION PREVAILED.

H.F. 1531 (Loeffler): Classified employee expectations established as nonpartisan resources to all decision makers, and additional whistleblower protection provided to state
employees.

Chair Mullery moved HF 1531 be recommended to pass and be placed on the General Register.

Chair Mullery moved adoption of the following oral amendment:
Page 1, Line 1.17, delete "that is not public data under chapter 13"
Page 1, Line 1.17, insert "otherwise protected by law"

Chair Mullery renews the motion that HF 1531, as amended, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED. A Division was requested: 4 YEAS and 3 NAYS. THE MOTION PREVAILED.
