JUDICIARY POLICY AND FINANCE COMMITTEE

MINUTES

Representative Shimanski, Vice Chair of the Judiciary Policy and Finance Committee, called the meeting to order at 8:17 A. M. on April 12, 2011, in Room 10 (Ground Floor) of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Mazorol moved approval of the March 24, 2011 Judiciary Policy and Finance Committee minutes. THE MOTION PREVAILED.

HF0795 (Hoppe) Human services commissioner instructed to initiate a foreign reciprocal agreement.

Representative Gruenhagen moved that HF0795 be recommended to pass and placed on the General Register.

Representative Hoppe presented HF0795.

Heidi Shea testified on HF0795.

Representative Gruenhagen renewed the motion that HF0795 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF1124 (Anderson) Rehabilitation presumption established through a person's honorable military service following a prior offense.

Representative Shimanski moved that HF1124 be recommended to pass and placed on the General Register.

Representative Shimanski moved the H1124A1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Anderson presented HF1124, as amended.

John Baker, Baker Williams, LLP and Trista Matascatillo, Chair, MN Veterans Initiative Working Group testified on HF1124, as amended.

Representative Shimanski laid over HF1124, as amended, for possible inclusion in an omnibus bill, or further action at a later time.
HF0229 (Downey) Judges authorized to prohibit juvenile sex offenders from residing near their victims.

Representative Kriesel moved that HF0229 be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance committee.

Representative Shimanski moved the H0229A3 amendment. THE AMENDMENT WAS ADOPTED.

Representative Downey presented HF0229, as amended.

Nancy Haas, Minnesota County Attorneys Association, testified on HF0229, as amended.

Jeff Diebel, House Research, and Emily Adriaens, House Fiscal Analyst, presented HF0229, as amended.

Representative Kriesel renewed the motion that HF0229, as amended, be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance committee. THE MOTION PREVAILED.

HF0056 (Dill) Veteran waiver of immunity provided to sue the state of Minnesota as an employer in federal or other courts for violation of the Uniformed Services Employment and Reemployment Rights Act.

Representative Johnson moved that HF0056 be recommended to pass and re-referred to the Civil Law committee.

Representative Dill presented HF0056.

Marty Breaker and Mike Mcelhiney, Veterans Administration, testified on HF0056.

Representative Shimanski laid over HF0056 for possible inclusion in an omnibus bill, or further action at a later time.

HF1370 (Paymar) Law enforcement data sharing permitted.

Representative Johnson moved HF1370 be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance.

Representative Paymar presented HF1370.

John Menke, Ramsey County Attorney's Office, Tara Patet, City of St. Paul Attorney’s Office, Commander Axel Henry, St. Paul Policy Department, and Ellen Pence, Blueprint for Safety, testified on HF1370.

Representative Johnson renewed the motion that HF1370 be recommended to pass and re-referred to the Public Safety and Crime Prevention Policy and Finance. THE MOTION PREVAILED.

HF0201 (Scott) Abortion funding limited for state-sponsored health programs.

Representative Vogel moved that HF0201 be recommended to pass and placed on the General Register.

Representative Scott presented HF0201.

Jordan Bauer, MCCL, Teresa Collett, University of Thomas School of Law, Charles Samuelson, ACLU-MN, Rev. T. Michael Rock, Robbinsdale United Church of Christ, and
Linnea House, NARAL Pro-Choice Minnesota testified on HF0201.


Representative Vogel renewed the motion that HF0201 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.
