HEALTH AND HUMAN SERVICES REFORM COMMITTEE

MINUTES

Representative Gottwalt, Chair, of the Health and Human Services Reform Committee, called the meeting to order at 2:32 P.M. on April 13, 2011, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Representative Benson moved the approval of minutes of April 12, 2010. THE MOTION PREVAILED.

HF1184 (Anderson, S) Family day care requirements modified.

Representative Gottwalt moved that HF1184 be recommended to pass and be laid over for possible inclusion in the Health & Human Services Omnibus bill.

Representative Gottwalt moved the H1184A1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Anderson testified on HF1184

The bill was laid over for possible inclusion in the ominous bill.

HF1166 (Gottwalt) State permitted to contract with third-party administrators to provide medical assistance benefits, competitive request for proposal process required, and mandatory participation by health maintenance organizations repealed.

Representative Gottwalt moved that HF1166 be recommended to pass and be re-referred to the Committee on Health and Human Services Finance.

Testifying on HF1166 were Representative Gottwalt, Kathryn Kmit, Director Policy and Government Affairs, Minnesota Council of Health Plans, Scott Leitz, Minnesota Department of Human Services and Dave Renner, Minnesota Medical Association.

Representative Gottwalt moved to lay the bill on the table for consideration later during the committee meeting.

HF905 (Hamilton) Youth athletes with concussions resulting from participation in youth athletic activities policies established.

Representative Gottwalt moved that HF905 be recommended to pass and be re-referred to the Committee on Government Operations.

Testifying on HF905 were; Representative Hamilton, David King, Executive Director of Brain Injury Association of Minnesota, Kayla Meyer, Michael Bergeron, PhD, FACSM, Director, National Institute for Athletic Health and Performance, Mark Carlson, MD, Sports and Occupational Medicine, Sanford Bemidji, and Brent Milikin, President, Minnesota Athletic Training Association.

Representative Gottwalt renewed his motion that HF905 be recommended to pass and be re-referred to the Committee on Government Operations. THE MOTION PREVAILED.

HF1406 (Hamilton) Continuing care provisions amended, telephone equipment program changed, disability service provisions changed, comprehensive assessments and case management services reformed, nursing facility provisions changed, and technical and conforming changes made.

Representative Gottwalt moved that HF1406 be recommended to pass and go to the General Register

Representative Gottwalt moved the HF1406A2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Gottwalt moved to reconsider the HF1406A2 amendment. THE MOTION PREVAILED.

Representative Gottwalt moved the following oral amendment: P. 1, L. 1.14 after "recipient" strike the existing language and insert a period, "Delete" L. 1.27, L.2.1 after lines "change" 32 to 26 and 35 to 34. THE MOTION PREVAILED.

Representative Gottwalt moved the HF1406A2, as amended, be recommended to pass. THE MOTION PREVAILED.

Testifying on HF1406 were: Sarah Maheswaran, Supervisor, DHS, Deaf and Hard of Hearing Division, Kathy Kelly, Supervisor, DHS, Disability Services Division, Heidi Hamilton, DHS, Disability Services Division and Bob Held, Director, Nursing Rates and Policy Division.

Representative Gottwalt renewed his motion that HF1406 be recommended to pass and go to the General Register. THE MOTION PREVAILED.

The meeting was recessed at 4:23 P. M.

Representative Barrett assumed the gavel at 6:07

HF1166 (Gottwalt) State permitted to contract with third-party administrators to provide medical assistance benefits, competitive request for proposal process required, and mandatory participation by health maintenance organizations repealed.

Representative Liebling moved the following oral amendment. P. 3, L. 3.31 after the period "insert" The Commissioner shall provide services under the RFP process thru a State operated option.

Representative Benson requested a roll call vote. The results were as follows;

Voting AYE were Representatives Gottwalt, Abeler, Mack, Barrett, Fritz, Hosch, Huntley, Liebling, Loeffler, McDonald, Moran.

Voting NAY were Representatives: Mack, Benson, Franson, Lohmer, McElfatrick

Absent were: Gruenhagen, Kiffmeyer, Murphy, Norton, Peterson

On a vote of 10 AYES and 6 NAYS THE ORAL AMENDMENT WAS ADOPTED.

Representative Gottwalt moved that HF1166, as amended, be adopted. THE MOTION PREVAILED.

Representative Mack assumed the gavel at 7:15 P.M.

HF222 (Gottwalt) Health plans guaranteed issue in the individual market required; Minnesota Comprehensive Health Association reinsurance of ceded risk on certain health plans required, and additional enrollment ended.

Representative Gottwalt moved that HF222 be recommended to pass and be re-referred to the Committee on Commerce and Regulatory Reform.

Representative Gottwalt moved the H0222DE1 amendment. THE AMENDMENT WAS ADOPTED.

Testifying on HF222 were: Representative Gottwalt, Chris Schneeman, MAHU and Agent's Coalition, Kathryn Kmit, Director Policy and Government Affairs, Minnesota Council of Health Plans, and John Tyler and Bob Johnson, Insurance Federation of Minnesota.

Representative Gottwalt moved to lay HF222 on the table.

HF1138 (Abeler) Case management and personal care assistance appeals conference required.

Representative Abeler moved that HF1138 be recommended to pass and be sent to the General Register.

Representative Abeler moved the HF1138A1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Abeler moved that HF1138, as amended, be recommended to pass. THE MOTION PREVAILED.

HF1383 (Abeler) Alcohol and drug counselor licensure requirements modified.

Representative Abeler moved HF1383.

Representative Abeler moved to orally amend HF1383 by: P. 9, L. 9.8 "delete" everything after permit, P. 10, "delete" everything thru L.,10.35 THE ORAL AMENDMENT WAS ADOPTED.

Representative Abeler moved the H1383A1 amendment with the following oral amendment: after counselors "insert" when providing service to Indian people. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Abeler moved to lay the bill on the table.

HF1382 (Abeler) Health board licensing provisions changed.

Representative Abeler moved HF1382.

Representative Abeler moved the HF1382A1 amendment. THE AMENDMENT WAS ADOPTED.

Representative Abeler moved the HF1382A2 amendment. THE AMENDMENT WAS ADOPTED.

Testifying on HF1382 were: Representative Abeler, Kari Rechtzigel, Executive Director, Minnesota Board of Behavioral Health and Therapy, Dr. Jonathon Uecker, Minnesota Psychiatric Society, Marshall Shragg, Executive Director, Minnesota Board of Dentistry and Dick Diercks, Executive Director of the MN Dental Association.

Representative Abeler laid HF1382 on the table.

HF1191 (Abeler) Social worker licensure provisions modified.

Representative Gottwalt assumed the gavel at 9:01P.M.

Representative Abeler moved that HF1191 to be recommended to pass and be laid over for possible inclusion in the Health & Human Services Omnibus bill.


Testifying on HF1191 were: Representative Abeler, Kate Zacher-Pate, Executive Director, Minnesota Board of Social Work, Ken Middlebrooks, Board Chair, Minnesota Board of Social Work, Sue Abderholden, Executive Director, NAMI Minnesota, Judith Brumfield, Deputy Director, Scott County Community Services, John Herzog, Senior Social Worker, Hennepin County Human Services and Public Health, Clifford Robinson, Clarke Gustafson, Human Service Director, Meeker County, Rod Halverson, and Dr. Christine Black-Huges.

HF1191 was laid over for possible inclusion in the Health & Human Services Reform Omnibus bill.

Representative Mack assumed the gavel at 10:20 P.M.

HF1423 (Gottwalt) Child safety and permanency reform provided, including adoptions of children under guardianship of the commissioner, and criminal penalties provided.

Representative Gottwalt moved that HF1423 be recommended to pass and be re-referred to the Committee on Judiciary Policy.

Representative Gottwalt moved the HF1423A1 amendment. THE AMENDMENT WAS ADOPTED.

Testifying on HF1423 were: Representative Gottwalt, Christeen Borsheim, Director, DHS, Child Safety and Permanency, Melinda T. Hugdahl, Staff Attorney, Legal Services Advocacy Project.

Representative Gottwalt renewed his motion that HF1423, as amended, be recommended to pass and be re-referred to the Committee on Judiciary Policy. THE MOTION PREVAILED.

HF1373 (Gottwalt) Maternal and Child Health Advisory Task Force extended.

Representative Gottwalt moved that HF1373 be recommended to pass and be re-referred to the committee on Judiciary Policy and Finance.

Representative Gottwalt moved to orally amend HF1373 by: L. 1.15 "change" 2021 to 2015. THE ORAL AMENDMENT WAS ADOPTED.

Testifying on HF1373 were: Representative Gottwalt, Maggie Diebel, Division Director, MDH, Community and Family Health Division.

Representative Gottwalt moved that HF1373, as amended, be adopted and be re-referred to the Committee on Judiciary Policy and Finance. THE MOTION PREVAILED.
