On Wednesday, the Minnesota Supreme Court ruled that Minnesota’s Human Rights Act allows a biological male who identifies as female to participate in women’s and girls’ athletics.
It is also worth noting that every Minnesota Supreme Court justice was appointed by a Democrat governor, including 4 justices that were appointed by Governor Walz.
Specifically, the Court ruled in a case where a transgendered athlete – a biological man – was prevented from competing in USA Powerlifting’s women’s division. Citing Minnesota’s Human Rights Act, the Court found that this ban was “facially discriminatory.”
Talk about complete nonsense.
Title IX guarantees women and girls the right to compete on a level playing field. That is federal law. And yet, Minnesota’s Supreme court believes a “public accommodation” discrimination statute that was passed by an all DFL-led legislature and Governor Walz in 2023 trumps any federal law that protects young women and ensures fairness in girls’ sporting events?
It should be common sense that if you were born as a male, and want to play sports, you will play in boys or men’s competitions. Clearly the liberal justices on the Minnesota Supreme Court do not share the same views as most Americans. A New York Times poll found roughly 8 out of 10 people believe girls sports should only be reserved for girls, including 67% of Democrats.
It’s now very clear that the legislature must approve the Preserving Girls Sports Act next session. The proposal specifically states that only students of the female sex may participate in an elementary or secondary school athletic team or sport that an educational institution has restricted on the basis of sex to women or girls. If there is a dispute, a student must present a signed physician’s statement indicating the student’s sex is based solely on the student’s internal and external anatomy, natural occurring level of testosterone, and an analysis of the student’s chromosomes.
The key will be finding one – just one – Democrat to help House Republicans move this bill forward. As you know, with a statistical tie in the Minnesota House between Republicans and Democrats, one DFL’er will need to recognize that girls are now being treated unfairly in the State of Minnesota. Will we find just one Democrat that is willing to step away from the woke agenda of the inner-city liberals and prioritize girls in this state? If not, we are headed towards the elimination of sex-based distinctions in girls’ and women’s sports in Minnesota.
