MINUTES


Representative Kahn, Chair of the Division, called the meeting to order at 8:42 A.M. on March 29, 2007 in Room 300 North of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Testifying against Page 54, Section 76 of the A07-0440 amendment to HF 953 (Minnesota State High School League rules subjected to the Administrative Procedure Act) were:

At 9:34 A.M. Chair Kahn recessed the meeting until the call of the Chair.

Chair Kahn reconvened the Committee at 1:49 P.M. on March 29, 2007 in Room 300 North of the State Office Building.

Chair Kahn moved that HF 953 be heard and recommended to pass to the Finance Committee.

Chair Kahn moved that the delete everything amendment A07-0440 (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A37 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.


Chair Kahn moved that the H0953-A38 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A57 amendment (attached) be adopted.

Representative Poppe moved an oral amendment to the H0953-A57 amendment as follows:

Page 1, line 3 after "section 76"
insert "."

Page 1 delete lines 4 through 14

THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Representative Hortman requested a division vote. The results were: 7 AYES and 4 NAYS. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn withdrew the H0953-A57 amendment.

Representative Poppe moved that the H0953-A57 amendment, as amended, be adopted and requested a division vote. The results were: 6 AYES and 5 NAYS. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Hilty moved that the H0953-A58 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved a handwritten amendment A72, to HF 953, as follows, be adopted:

Page 49, line 15 after "on behalf of an agency."
delete ". An agency must hire"
insert "without seeing if the service can be provided for by"

Page 49, line 15 after "state employees"
delete "to provide these"


Page 49, line 16 delete the first instance of the word "services"

after "located in"
delete "Minnesota"
insert "the United States"

Representative DeLaForest moved to incorporate an oral amendment to the A72 amendment as follows:

Page 49, line 15 after "without"
delete "seeing"
insert "determining"

Chair Kahn incorporated the DeLaForest oral amendment into the A72 amendment.

Chair Kahn renewed her motion that the handwritten amendment A72, as incorporated, be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A39 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.


Representative DeLaForest moved that the H0953-A42 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A44 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A43 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Winkler moved that the H0953-A45 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A46 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Vice-Chair Ward moved that the H0953-A54 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative DeLaForest moved an oral amendment to HF 953 as follows:
Page 76 delete Section 116
Page 9 delete lines 28 and 29 and reduce the appropriations accordingly

Representative Davnie testified against the DeLaForest oral amendment.

Representative DeLaForest renewed his motion to adopt the oral amendment to HF 953. THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Chair Kahn moved that the H0953-A47 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Vice-Chair Ward moved that the H0953-A36 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Sviggum moved that the H0953-A53 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A55 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A56 amendment (attached) be adopted.

Gary Thaden, Government Affairs Director, Minnesota Mechanical Contractors Association / National Electric Contractors Association, testified in support of the A-56 amendment.

Chair Kahn renewed her motion that the H0953-A56 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Sviggum moved that the H0953-A60 amendment (attached) be adopted. THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Chair Kahn moved that the handwritten A61 amendment (attached) be adopted.

John Lally, Planning Director, Office of Enterprise Technology, testified in support of the A61 amendment.

Chair Kahn renewed her motion that the handwritten A61 amendment be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Chair Kahn moved that the H0953-A48 amendment (attached) be adopted. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Representative Peppin moved an oral amendment to HF 953 as follows:
Page 55 delete Section 77

Iris C. Freeman, Policy Advisor, Alzheimer's Association, testified against the Peppin oral amendment.

Representative Peppin renewed her motion to adopt her oral amendment to HF 953. THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Representative Zellers moved an oral amendment to HF 953 as follows:
Page 103 delete Section 15

Representative Zellers requested a roll call vote. The results were as follows:

On a vote of 5 AYES and 8 NAYS, THE MOTION DID NOT PREVAIL AND THE AMENDMENT WAS NOT ADOPTED.

Beth Fraser, Director of Governmental Affairs for the Secretary of State's Office, testified in response to a question from Representative Sviggum.

Chair Kahn renewed her motion that HF 953, as amended, be recommended to pass and be re-referred to the Finance Committee.

Representative DeLaForest requested a roll call vote. The results were as follows:
